To The Honorable Board of Examiners of Said County:

Your petitioner, Mrs. A. D. Stewart, respectfully represents to your Honorable Board that she is a citizen of Bibb county, in the State of Alabama, and was such on the first day of January, 1899, and that she is the widow of A. J. Stewart ,who served as a Private Company F of the 20 Regiment Ala Volunteers; that her husband was killed or died on the 22nd day of Sept, 1905; that he did not desert the service of the State of Alabama , nor of the Confederate States; that she has not since remarried; that she has no children that she can depend upon for support, that all her property do not exceed four hundred dollars in value, and that her annual income from all sources do not exceed four hundred dollars. She therefore asks your honorable board to place her name upon the rolls of the pension board of the State as a member of the fourth class, that she may participate in the division of the fund provided for the relief of needy Confederate soldiers and sailors, and their widows, by an act of the General Assembly of Alabama, approved February 10, 1899, and she filed herewith a complete inventory of all the property both real and personal, that she owns. That at the time of the death of her husband he was drawing a pension from the State of Alabama.

You are hereby notified that a charge has been duly preferred against you to the effect that you are ineligible for a pension under the laws of this State, because No record of military service, capture or parole
Within TWENTY DAYS from this date you can appear before me, at my office in the State Capitol, in person or by counsel, and offer testimony by witnesses or the affidavits of witnesses in explanation or refutation of said charges. In case you make your defense by the affidavit of witnesses, those affidavits must be made and signed and sworn to before the Probate Judge of your county, and duly attested by his official signature.

In the event that you fail within twenty days to make answer or defense to said charge, the charge will be taken as confessed, and your default will be duly reported to the State Board of Pension Examiners for final determination.

To the Honorable, The State Board of Pension Examiners:

The above named pensioner was duly cited to appear within twenty days from the 6th day of Sept, 1913, and on the 11th day of Sept 1913, did appear and made the following defense or explanation against him or her deceased husband.

Mrs. Stewart presents her affidavits of W. J. Schofield Wilson, Colburn, Wesley Colburn, and Thos. L. Kirkley to establish her husband's record as a soldier. Their irrelevancy and incoherence are apparent, and I repeat that she is not eligible to a pension.

Before me, W. L. Pratt, personally appeared Thomas L. Kirkley who being duly sworn, says that he was acquainted with One, A. J. Stewart in his lifetime, that he is acquainted with A. D. Stewart his widow, That affiant knows that said A. J. Stewart was in Company F, Twentieth Alabama in the latter part of 1864 and the Spring of 1865 as a private soldier; that said Stewart did faithful honest service as said soldier in said Company and Regiment and was duly and legally parolled at the surrender in the army operating after the siege of Vicksburge as said army approached Appomattox.

AFFIDAVIT OF TWO RELIABLE CITIZENS OF THE PRECINCT WHERE APPLICANT RESIDES

We, J. T. Kirkley, and R. H. Bamberg, our post offices addresses being Route # 2 Centerville, Ala., respectively, do solemnly swear that we have known Mrs. Amanda Drusilla Stewart, whose name is signed to the foregoing application 40 years and 40 years respectively, that we consider her to be a truthful and reliable person and do not believe that she would make a false statement for the purpose of securing a pension.
